An illegal alien who murdered his 8-month-old sister with a charging cord was allowed to remain in America after the Biden administration dismissed his deportation case as “low priority” just months before the killing.
Story Highlights
- Alvaro Mejia Ayala strangled his infant sister to death in Leesburg, Virginia after Biden administration dropped his deportation case
- The 22-year-old illegal alien entered the U.S. in 2016 and had previous arrests but was repeatedly released
- ICE has now filed an immigration detainer to prevent his release following murder charges
- DHS officials confirm the case exemplifies failures in immigration enforcement under previous administration
Biden Administration’s Deadly Immigration Policy Failure
Alvaro Mejia Ayala entered the United States illegally in 2016 as part of a family unit, taking advantage of catch-and-release policies that allowed border crossers to remain in the country while their cases languished in immigration courts.
His deportation case remained pending for years until October 2024, when the Biden administration dismissed it as a “low priority,” effectively granting him permission to stay in America. This decision would prove catastrophic just months later when the 22-year-old committed an unthinkable act of violence against his own family.
Horrific Crime Against Innocent Baby
On September 17, 2025, Leesburg police responded to a medical emergency call at a residence on Hancock Place NE. Officers discovered an 8-month-old infant girl with a charging cord wrapped around her neck, having been strangled by her older brother.
The baby was rushed to the hospital in critical condition but succumbed to her injuries six days later on September 23. Leesburg Police Chief Thea Pirnat made it clear this was no accident, stating definitively, “This was not an accident. A child was murdered in a deliberate act.”
Mejia Ayala initially fled the scene after the attack but was apprehended hours later by law enforcement. He now faces murder charges in addition to the initial strangulation charges and is being held without bond at the Loudoun County Detention Center.
The deliberate nature of this crime against a helpless infant demonstrates the deadly consequences of failed immigration policies that prioritize political correctness over public safety.
Pattern of Criminal Behavior and System Failures
This tragic murder was not Mejia Ayala’s first encounter with law enforcement. He had been previously arrested for reckless driving in 2024, but was released before ICE could file a detainer to take him into custody for immigration violations.
This pattern of catch-and-release, combined with the Biden administration’s decision to dismiss his deportation case as low priority, created the perfect storm that allowed a violent criminal to remain free on American streets.
The case exemplifies everything wrong with the previous administration’s approach to immigration enforcement.
Rather than prioritizing the removal of illegal aliens, the Biden administration systematically dismantled effective enforcement mechanisms and created categories of “low priority” cases that essentially provided amnesty to millions who had no legal right to be here. American families are paying the ultimate price for these reckless policies.
Federal Response and Damage Control
Following the infant’s death, U.S. Immigration and Customs Enforcement finally took action, filing an immigration detainer to ensure Mejia Ayala cannot be released back onto American streets.
DHS Assistant Secretary Tricia McLaughlin stated, “ICE lodged an immigration detainer to ensure this heinous criminal is not released on U.S. streets.” While this response is appropriate, it raises the obvious question of why such measures weren’t taken years ago when he first entered illegally or after his previous arrest.
The federal government’s scramble to contain the damage from this case cannot undo the loss of an innocent life or restore faith in a system that failed so completely.
This tragedy serves as a stark reminder that immigration laws exist to protect American citizens, and when those laws are ignored or selectively enforced for political purposes, innocent people die.
With President Trump, Americans can expect a return to common-sense immigration enforcement that prioritizes public safety over political ideology.
