Judge Hits Biden With Bombshell Order

(DCWatchdog.com) – In an unexpected but tremendous victory for American patriots, a US judge has issued an order to President Joe Biden forcing him to continue building the wall on the Southern Border with money allotted for the purpose under former President Donald Trump.

In a decision made at the end of last week, Judge Drew Tipton issued a preliminary injunction that stops the Biden administration from reallocating funds that were specifically set aside for the border wall’s construction.

In 2019, Congress sanctioned a substantial financial package slated to construct the border wall along the US-Mexican border.

However, Biden immediately terminated the construction of the border wall when he entered the White House three years ago.

This led Texas and Missouri to sue the Biden administration for not utilizing the allocated funds for their intended purpose, which is the construction of the border wall.

“The Government and all its respective officers, agents, servants, employees, attorneys, and other persons who are in active concert or participation with them are hereby ENJOINED and RESTRAINED from implementing the July 2022 Amended Plan to the extent that its obligations are not authorized under Subsection 209(a)(1) and Section 210 as laid out in this Order,” Judge Tipton wrote.

“The Government is prohibited from obligating funds under Subsection 209(a)(1)—and corresponding funds under Section 210—toward mitigation and remediation efforts, repair of existing barrier, so-called system attribute installation at existing sites, or other similar purposes. Those types of expenses may be authorized under Subsections (a)(2) through (a)(5) where appropriate, however, Subsection (a)(1) permits only the construction of physical barriers, such as additional walls, fencing, buoys, etc.,” the judge elaborated.

“This preliminary injunction shall remain in effect pending a final resolution of the merits of this case or until a further Order from this Court, the United States Court of Appeals for the Fifth Circuit or the United States Supreme Court,” he added.

The case, titled Texas v. Biden, is being heard in the United States District Court for the Southern District of Texas.

Dale Wilcox from the Immigration Reform Law Institute commented on the lawsuit by stressing the Biden administration’s opposition to immigration laws and applauded the court’s decision to enforce the construction of the wall as mandated by law.

Meanwhile, Texas Attorney General Ken Paxton blasted Biden’s actions in a statement.

“Biden acted completely improperly by refusing to spend the money that Congress appropriated for border wall construction, and even attempting to redirect those funds. His actions demonstrate his desperation for open borders at any cost, but Texas has prevailed,” the GOP AG said.
