(DCWatchdog.com) – In another legal victory, Republican presidential nominee Donald Trump won again, as Fulton County Georgia Judge Scott McAfee dismissed two charges against him in District Attorney Fani Willis’s election case.
Willis had indicted Trump and 18 others last August on Racketeer Influenced and Corrupt Organizations (RICO) charges, while Trump has pleaded not guilty.
However, McAfee issued orders based on motions filed by two defendants, Shawn Still and John Eastman, who are not part of that appeal, meaning the case against them is not paused.
In the Georgia case — one of four criminal prosecutions against the GOP leader — a grand jury in August 2023 returned a 41-count indictment against Trump and 18 others.
In such indictment, they were accused of participating in a wide-ranging conspiracy to illegally try to overturn Trump’s narrow loss in the 2020 presidential election in Georgia.
Four people pleaded guilty last year after reaching deals with prosecutors.
According to Reuters, McAfee specifically dropped charges related to the alleged filing of false documents in federal court, determining that the prosecutors lacked the authority to bring those charges.
Even though dropping these two counts was a win for Trump, it was not a complete victory.
McAfee allowed the case to continue with the remaining charges.
Moreover, the case has been stalled because Trump appealed McAfee’s decision to let Willis stay on the case despite concerns about her romantic involvement with Nathan Wade, a special prosecutor she hired to pursue it.
The judge ordered that either Wade or Willis step down, and Wade chose to step down the next day.
Nevertheless, Trump has also pushed for Willis’s removal.
In June, a Georgia Appeals Court paused the proceedings, pending oral arguments set for December.
