
(DCWatchdog.com) – Happening Now: A federal judge has halted President Joe Biden’s plan to end Title 42 deportations of illegal migrants before Biden’s plan even gets out of the starting gate.
First, some essential background.
Title 42 permits the United States to immediately deport foreign nationals deemed a danger to “public health” in the United States without going through the normal expulsion process. The administration of then-President Donald Trump first used Title 42 during the COVID-19 pandemic in March of 2020 to deport illegal immigrants who had crossed the southern border into the United States.
The Biden administration had announced it was terminating Title 42 deportations on or about May 23.
Now a Louisiana federal judge has stepped in and stopped the Biden administration’s efforts to end deportations of illegal immigrants under Title 42 of the U.S. Code less than a month before Biden’s intended date.
Judge Robert Summerhays (a Trump appointee to the U.S. District Court in the Western District of Louisiana) announced the order in a one-page notice. He is the judge in Louisiana v. CDC. Arizona, Missouri, and others joined this lawsuit against the Biden administration for its plans to discontinue Title 42’s use as of May 23.
Summerhays issued a temporary restraining order to allow Title 42 expulsions to continue. The temporary restraining order will expire on May 9. Arguments for a formal injunction might be considered.
