CRAZY: JetBlue Sued for THIS?

(DCWatchdog.com) – Stirring debate on in-flight service safety, a New Jersey woman is suing JetBlue over a “dangerously cold” ice cream sandwich that allegedly broke her tooth during a flight.

Kiara Quinonez claimed she fractured her front tooth on a frozen solid strawberry shortcake ice cream sandwich during an August 20 flight from New York to Paris.

Instead of taking personal responsibility, she is demanding damages for “pain, suffering, and mental anguish” in a lawsuit filed October 22 in New York’s Eastern District Court.

The lawsuit accused JetBlue of negligence for serving food at an unsafe temperature and failing to warn passengers about the dessert’s frigid state.

Quinonez’s lawyer, Christopher Fraser, is demanding a jury trial and seeking unspecified damages.

“The ice cream sandwich that [Jet Blue] served … was frozen solid and caused [her] to sustain severe bodily injuries, including a root fracture of tooth number 10,” the lawsuit read.

Moreover, the plaintiff asserted she required emergency dental work upon landing in Paris, including tooth extraction and an implant.

Meanwhile, this is not the first time JetBlue has faced lawsuits over food and beverage temperatures. In June, another passenger sued over “dangerously hot” tea spilled during turbulence.

The ice cream sandwich in question was made by Nightingale Ice Cream, a company generally well-reviewed for its products. This indicates the dessert was likely of normal quality and temperature for a frozen treat.

The lawsuit continued, “As a direct and proximate result of the acts of Defendant, its agents and/or servants as aforedescribed, Plaintiff sustained severe and permanent bodily injuries, suffered pain, suffering and mental anguish, and incurred expenses for medical care and treatment, all of which are continuing.”

As the lawsuit represents a disturbing trend of individuals seeking to profit from minor incidents by exploiting the legal system, the Congress should enact meaningful tort reform to protect businesses from these types of situations and ensure the courts are used for legitimate claims.
