(DCWatchdog.com) – In a truly bombshell twist in the case of Derek Chauvin, there is now a chance that he might be innocent of killing George Floyd in 2020.
A U.S. district court ruling now allows Chauvin’s defense team access to George Floyd’s heart tissue, fueling an appeal to contest Chauvin’s federal civil rights conviction.
This move tests the boundaries of justice, as new evidence could potentially shift the narrative surrounding Floyd’s death.
Derek Chauvin’s legal team recently gained permission to test George Floyd’s heart tissue, aiming to challenge the federal civil rights conviction received post-Floyd’s demise.
U.S. District Judge Paul Magnuson approved this request, acknowledging the new evidence’s potential to support an alternate opinion on Floyd’s cause of death.
With access to Floyd’s histology slides and heart tissue samples, the defense is exploring whether Floyd’s death involved the heart condition known as takotsubo cardiomyopathy—a medical ailment connected to extreme stress.
Dr. William Schaetzel suggested that this condition might offer insight beyond the original charges of asphyxiation, The Western Journal reports.
“Given the significant nature of the criminal case that Mr. Chauvin was convicted of, and given that the discovery that Mr. Chauvin seeks could support Dr. Schaetzel’s opinion of how Mr. Floyd died, the Court finds that there is good cause to allow Mr. Chauvin to take the discovery that he seek,” Magnuson ruled.
Chauvin’s current legal representation, Robert Meyers, is working to prove that critical forensic evidence was overlooked by the original defense, led by Eric Nelson.
Chauvin alleges “ineffective assistance counsel” for not pursuing alternate medical opinions that might have changed the trial’s outcome.
With Floyd’s autopsy revealing high fentanyl levels, Chauvin’s defense posits an alternate scenario of overdose rather than asphyxiation.
This line of inquiry challenges narratives held by those who accused Chauvin of intentionally causing Floyd’s death, questioning the scientific rigor of the earlier conviction procedures.
